How we support the heirs

  • Locate and interpret the Spanish and foreign wills and confirm who the legal heirs are.
  • Obtain the death certificate, Last Wills certificate and all documentation required by the notary.
  • Prepare and sign the deed of acceptance of inheritance, on your behalf if needed.
  • Calculate, optimise and pay Spanish inheritance tax within the legal deadlines.
  • Register the inherited property and assets in the names of the heirs at the Land Registry.
  • Coordinate with banks to release accounts and transfer the remaining assets.

Documentation

We draft and sign the notarial deed accepting the estate and distributing it among the heirs.

Inheritance tax

We calculate and pay inheritance tax within the deadline, applying every available allowance and reduction.

Registration

We register the assets in the heirs' names and release bank accounts, completing the transfer cleanly.

Is there a deadline to pay Spanish inheritance tax?

Yes. Spanish inheritance tax must generally be settled within six months of the date of death, although an extension can be requested. We make sure deadlines are met to avoid surcharges.

Do I need to travel to Spain to accept the inheritance?

Not necessarily. Through a Power of Attorney we can carry out the entire process — signing the deed of acceptance and dealing with tax and registration — on your behalf.

What if the deceased had a will in their home country?

We work with foreign wills and coordinate with your home-country advisers so that the Spanish assets are dealt with correctly and in line with the overall estate plan.

What happens if there is no will?

Where there is no will, Spanish or international rules determine the legal heirs. We establish who inherits, prepare a declaration of heirs and guide the estate through to registration.
