Seller questions, answered

What is the 3% non-resident retention?

If you are a non-resident seller, the buyer is obliged to withhold 3% of the price and pay it to the Spanish tax authority on account of your capital gains tax. We advise on this and help you reclaim any excess where applicable.

Can you complete the sale if I live abroad?

Yes. With a Power of Attorney we can sign the deed and complete the sale at the notary on your behalf, so you do not need to travel to Spain.

What if there is still a mortgage on the property?

We coordinate with your bank to obtain the outstanding balance and arrange the cancellation of the mortgage at completion, so the buyer receives a clean title and you receive the net proceeds.

What documents will I need?

Typically the title deed, latest IBI (council tax) receipt, energy performance certificate, community certificate and utility bills. We tell you exactly what is required and help you obtain anything missing.
